山东举办跨境商事仲裁实务交流活动

近期，跨境商事仲裁实务交流活动在山东威海顺利举办。本次活动以“深化跨境仲裁协作 赋能涉外法治发展”为主题，由山东省仲裁协会、山东大学、大连海事大学联合主办，威海仲裁委员会、威海市律师协会、山东省仲裁协会涉外仲裁专业委员会承办，北京德和衡律师事务所协办。山东省司法厅副厅长何旭、威海市人民政府副市长袁志勇、山东省仲裁协会会长张公博、山东大学法学院副院长付本超、大连海事大学法学院海商法系主任夏元军出席活动并先后致辞。本次活动累计吸引海内外法学专家、知名仲裁机构、企业代表及法律实务工作者共550余人次参加，共同探寻涉外仲裁高质量发展新路径。

Recently,  the Cross-Border Commercial Arbitration Practical Exchange Event was successfully held in Weihai, Shandong. Centered on the theme "Deepening Cross-Border Arbitration Collaboration to Empower the Development of Foreign-Related Rule of Law," the event was jointly organized by the Shandong Arbitration Association, Shandong University, and Dalian Maritime University, hosted by the Weihai Arbitration Commission, the Weihai Lawyers Association, and the Foreign-Related Arbitration Professional Committee of the Shandong Arbitration Association, and co-organized by the Beijing DHH Law Firm. Attendees at the opening ceremony included He Xu, Deputy Director of the Department of Justice of Shandong Province; Yuan Zhiyong, Vice Mayor of the Weihai Municipal People's Government; Zhang Gongbo, President of the Shandong Arbitration Association; Fu Benchao, Associate Dean of the Law School of Shandong University; and Xia Yuanjun, Director of the Maritime Law Department at Dalian Maritime University's Law School, all of whom delivered speeches. The event attracted over 550 participants, including domestic and international legal experts, renowned arbitration institutions, corporate representatives, and legal practitioners, jointly exploring new pathways for the high-quality development of foreign-related arbitration.

开幕仪式结束后，跨境仲裁协作交流推介会正式开展。推介环节由威海国际仲裁院执行院长刘润东主持。英国杜伦大学国际仲裁与中国法讲席教授、欧洲科学院院士、资深国际仲裁专家陈磊围绕深化涉外仲裁交流、服务全方位对外开放格局作主旨发言；北京仲裁委员会副秘书长张皓亮分享北仲在机构规范化建设、国际化仲裁实践方面的守正创新探索；新加坡国际仲裁中心中国区战略发展经理沈冬卉介绍新加坡国际仲裁中心情况及其全球仲裁业务实践；香港一邦国际网上仲裁调解中心副总裁兼秘书长黄一文聚焦法律科技赋能多元化商事争议解决作分享；外籍仲裁员Christine Miles围绕中国仲裁制度发展与国际化建设展开交流。

Following the opening ceremony, the Cross-Border Arbitration Collaboration and Promotion Conference commenced. The promotion segment was moderated by Liu Rundong, Executive Director of the Weihai International Arbitration Court. Professor Chen Lei, Chair Professor of International Arbitration and Chinese Law at Durham University, Fellow of the European Academy of Sciences, and a seasoned international arbitration expert, delivered a keynote speech on deepening foreign-related arbitration exchanges and serving the pattern of all-round opening-up. Zhang Haoliang, Deputy Secretary-General of the Beijing Arbitration Commission, shared the Commission's explorations in institutional standardization and international arbitration practices. Shen Donghui, Strategic Development Manager for China at the Singapore International Arbitration Centre, introduced the Centre and its global arbitration business practices. Huang Yiwen, Vice President and Secretary-General of eBRAM International Online Dispute Resolution Centre in Hong Kong, shared insights on legal technology empowering diversified commercial dispute resolution. Foreign arbitrator Christine Miles engaged in discussions on the development and internationalization of China's arbitration system.

16日下午同步开设两场专业培训。其中《企业境外仲裁实务与风险防范》专题培训由陈磊教授牵头主持，并联合三位行业专家开展系列授课。陈磊教授以《普通法视角下当前中国涉外仲裁面临的挑战和困惑》为题开篇讲解；国际商会（ICC）争议解决业务北亚地区副主任张安然围绕《企业参与国际仲裁的三个误区和预防争议的三个技能》进行授课；中铁十五局集团法律合规部总经理时海宇结合建筑央企涉外项目，详解涉外仲裁实操要点与注意事项；威海国际仲裁院院长刘克江分享涉外案件代理思路与仲裁员执业实操经验。授课结束后，陈磊教授结合各位专家分享内容逐一点评，并抛出实务难点议题，与授课专家展开深度研讨答疑。

On the afternoon of June 16, two specialized training sessions were held simultaneously. The first, titled "Practical Training on Overseas Arbitration for Enterprises and Risk Prevention," was led by Professor Chen Lei, who also delivered the opening lecture on "Challenges and Perplexities in Current Chinese Foreign-Related Arbitration from a Common Law Perspective." Zhang Anran, Deputy Director for North Asia of the ICC Dispute Resolution Services, gave a lecture on "Three Misconceptions in Corporate Participation in International Arbitration and Three Skills for Dispute Prevention." Shi Haiyu, General Manager of the Legal Compliance Department of China Railway 15th Bureau Group, elaborated on key practical points and precautions in foreign-related arbitration based on the group's overseas projects. Liu Kejiang, President of the Weihai International Arbitration Court, shared practical experience in handling foreign-related cases and serving as an arbitrator. Following the lectures, Professor Chen Lei provided commentary on each expert's presentation and raised challenging practical issues for in-depth discussion and Q&A with the speakers.

同期开展的新《海商法》专题培训由威海仲裁委员会海洋仲裁院院长贾建伟主持，大连海事大学夏元军副教授主讲。夏元军围绕新版《海商法》核心修订条款逐条解读，紧密结合海事仲裁真实案例，针对新法实施后涉海案件审理、纠纷调解、证据认定等实操痛点给出专业实操指引，并现场逐一回应企业、法律从业者提出的实务问题。

The concurrently held "New Maritime Code" specialized training was moderated by Jia Jianwei, President of the Maritime Arbitration Court of the Weihai Arbitration Commission, and delivered by Associate Professor Xia Yuanjun from Dalian Maritime University. Xia provided a detailed interpretation of the key amendments to the new Maritime Code, closely integrating real maritime arbitration cases. He offered professional practical guidance on challenges in case adjudication, dispute mediation, and evidence identification related to maritime cases after the implementation of the new law, and answered practical questions raised by enterprises and legal practitioners on the spot.

17日上午，活动进入压轴环节——“企业出海仲裁需求与法律服务精准对接”主题圆桌交流会如期举行。杜伦大学国际仲裁与中国法讲席教授陈磊、中国社会科学院西亚非洲研究所（中国非洲研究院）非洲法律研究中心主任朱伟东、山东大学法学院副院长付本超、德和衡印尼办公室主任黄荣（视频在线参加）、中天德成国际咨询有限公司总经理孙建波、威海国际仲裁院院长刘克江、执行院长刘润东、外籍仲裁员Christine Miles等专家，与威高集团、迪尚集团、威建集团、威海国际合作公司、城投集团、产投集团、宇王集团等本地重点涉外涉海企业代表、仲裁及律师行业代表展开座谈。与会专家聚焦东南亚、中亚、非洲三大海外投资重点区域，梳理跨境投资高频法律风险，匹配适配的跨境仲裁法律服务方案。现场互动交流踊跃，参会企业接连抛出实务难题，专家逐一细致解答，研讨氛围热烈，原定会议时长多次顺延。

On the morning of June 17, the event reached its culminating session: the "Corporate Overseas Arbitration Needs and Precise Matching of Legal Services" roundtable exchange. Experts including Professor Chen Lei from Durham University, Zhu Weidong, Director of the African Law Research Center at the Institute of West Asian and African Studies, Chinese Academy of Social Sciences, Fu Benchao from Shandong University, Huang Rong (participating via video), General Manager of the DHH Indonesia Office, Sun Jianbo, General Manager of Zhongtian Decheng International Consulting Co., Ltd., Liu Kejiang and Liu Rundong from the Weihai International Arbitration Court, and foreign arbitrator Christine Miles, engaged in discussions with representatives from key local foreign-related and maritime enterprises such as WEGO Group, Dishang Group, Weijian Group, Weihai International Cooperation Company, Chengdu Investment Group, Chantui Investment Group, and Yuwang Group, as well as representatives from the arbitration and legal professions. The experts focused on three major overseas investment regions—Southeast Asia, Central Asia, and Africa—identifying high-frequency legal risks in cross-border investment and proposing tailored cross-border arbitration legal service solutions. The interactive session was lively, with participating enterprises raising practical challenges and experts providing detailed responses, leading to an enthusiastic atmosphere that repeatedly extended the scheduled meeting time.

17日下午，威海国际仲裁院院长刘克江走进威海经区智慧谷产业园区，以《国际贸易风险与合规管理》为题，为园区近百家涉外企业开展专场普法培训。

On the afternoon of June 17, Liu Kejiang, President of the Weihai International Arbitration Court, visited the Weihai Economic Zone Smart Valley Industrial Park to deliver a specialized legal training session titled "International Trade Risks and Compliance Management" for nearly 100 foreign-related enterprises in the park.

此次交流活动内容充实、覆盖面广、实务性强，为山东省涉外法治体系完善、涉外法律专业人才培育搭建了优质交流平台，有效帮助涉外企业厘清跨境经营法律风险，全面提升企业海外经营法律风险防范与纠纷化解能力。（李建国）

This exchange event was rich in content, broad in scope, and highly practical, providing an excellent platform for improving Shandong's foreign-related rule of law system and cultivating foreign-related legal professionals.
